Mit der Verordnung (EU) 2019\/452 des Europ\u00e4ischen Par-laments und des Rates vom 19. M\u00e4rz 2019 zur Schaffung eines Rahmens f\u00fcr die \u00dcberpr\u00fcfung ausl\u00e4ndischer Direk-tinvestitionen in der Union, EU ABl. L 79 I\/1, (FDI-Screening-VO) ist nunmehr auch die EU in diesem Themenfeld gesetzgeberisch aktiv geworden. Die Umsetzung der Verordnung in den Mitgliedstaaten ist in vollem Gange: In \u00d6sterreich erfolgt sie durch das neue Bundesgesetz \u00fcber die Kontrolle von ausl\u00e4ndischen Direktinvestitionen (Investitionskontrollgesetz \u2013 InvKG). Der von der EU verfolgte Ansatz zur Koordination und Kooperation unter den Mitgliedstaaten in Fragen der si-cherheitstechnischen Investitionskontrolle ist zu begr\u00fc\u00dfen, jedoch gerade auch mit Blick auf die potenzielle Dy-namik im Fortgang der Coronakrise noch ausbauf\u00e4hig, soweit es die kompetenziellen, grundfreiheitlichen und wirtschaftsv\u00f6lkerrechtlichen Grenzen zulassen.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Matthias Lehmann (Universit\u00e4t Wien) &amp; Marco Kretzschmar (Rheinische Friedrich-Wilhelms-Universit\u00e4t Bonn)<br>Investitionskontrollen in Europa &#8211; zwischen wirtschaftlichem Zweck, politischem Nutzen und rechtlicher Machbarkeit<br>FIW-Policy Brief 48<br>Oktober 2020<br>Sprache: Deutsch<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><span lang=\"en\" dir=\"ltr\" class=\"lang-attribute\">Abstract:<br>Worldwide, and not just since the Corona pandemic, trends toward tighter security-related investment controls can be observed &#8211; also in Europe. With Regulation (EU) 2019\/452 of the European Parliament and of the Council of 19 March 2019 establishing a framework for the verification of foreign direct investment within the Union, EU OJ L 79 I\/1, (FDI Screening Regulation), the EU has now also taken legislative action in this area. The implementation of the regulation in the member states is in full swing: In Austria, it is being carried out by means of the new Federal Act on the Control of Foreign Direct Investment (Investment Control Act &#8211; InvKG).
